Terms and Conditions of Service for Cebupantry

Welcome to Cebupantry! These Terms and Conditions ("Terms") govern your access to and use of the Cebupantry website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

By creating an account, placing an order, or otherwise using the Cebupantry Service, you confirm your acceptance of these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Cebupantry (referred to as "we," "us," or "our").
2. Eligibility
You must be at least 18 years old to use our Service and place orders. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
3. Account Registration
- You may be required to register an account to access certain features of the Service.
- You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Product Information and Availability
- We strive to provide accurate descriptions and images of products. However, we do not warrant that product descriptions or other content of this site are accurate, complete, reliable, current, or error-free.
- Product availability is subject to change without notice. In case a product you ordered is out of stock, we will notify you and offer alternatives or a refund for the unavailable item.
- Prices are subject to change without prior notice.
5. Ordering and Payment
- All orders placed through the Service are subject to acceptance by us.
- You agree to pay for all products and services purchased through your account at the prices then in effect.
- We accept [list accepted payment methods, e.g., GCash, Bank Transfer]. Cash on Delivery (COD) may be available for select areas/orders as indicated on the checkout page.
- Order totals will include product prices, delivery charges, and any applicable item count add-ons as displayed during the checkout process.
6. Delivery
- Delivery charges and estimated delivery times will be provided during the checkout process and may vary based on your location (city/barangay) and current demand.
- We aim to deliver within the estimated timeframe but do not guarantee specific delivery times. Delays may occur due to unforeseen circumstances (e.g., traffic, weather, high demand).
- It is your responsibility to provide accurate delivery information. We are not responsible for delayed or failed deliveries due to incorrect or incomplete address details.
- You or a designated representative must be available to receive the order at the provided address.
7. Returns, Refunds, and Cancellations
- **Damaged/Incorrect Items:** If you receive a damaged or incorrect item, please contact us immediately upon delivery within 24 hours of receipt with photographic evidence. We will arrange for a replacement or refund.
- **Non-Perishable Goods:** Returns for non-perishable goods may be accepted within 7 days of purchase if the item is unopened, unused, and in its original packaging, subject to a restocking fee.
- **Perishable Goods:** Due to the nature of perishable goods, we generally do not accept returns or offer refunds unless the item is delivered spoiled or unfit for consumption.
- **Cancellations:** Orders can only be cancelled before they have been prepared for dispatch. Please contact us as soon as possible if you wish to cancel an order. Once an order is out for delivery, it cannot be cancelled.
- Refunds will be processed within 3 business days to your original payment method or as store credit.
8. User Conduct
You agree not to use the Service for any unlawful purpose or in any way that could harm, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
9. Intellectual Property
All content on the Cebupantry website, including text, graphics, logos, images, and software, is the property of Cebupantry or its content suppliers and is protected by intellectual property laws.
10. Limitation of Liability
To the fullest extent permitted by law, Cebupantry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Cebu City, Central Visayas, Philippines.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date." Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
